Firstly, on the dossier of application for a certificate of food safety and hygiene:
1. For cases of first-time application, a dossier comprises:
• An application form No. 01a in the Appendix enclosed with Circular No. 43/2018 / TT-BCT
• Explanatory statement on facilities, equipment and tools that ensure food hygiene and safety conditions, made according to Form No. 02a (for production establishments) and Form No. 02b (for business establishments) or both Form No. 02a and Form No. 02b (for both facilities of production and business) in the Appendix issued together with Circular No. 43/2018 / TT-BCT;
• Health certificate / Summary list of health certification of establishment owners and people directly involved in food production and trading issued by a health facility at district level or higher (a certified copy of the certificate). department);
• Certificate of training in food safety knowledge / Certificate of food safety knowledge of the owner and the person directly involved in producing and trading food (a certified copy of the establishment). .
2. For cases of re-grant due to lost or damaged certificates:
An application form No. 01b in the Appendix enclosed with Circular No. 43/2018 / TT-BCT.
3. In case of application for re-issue because the establishment changes its production and business location; change and supplement production processes, business items and when the certificate expires
a) An application form according to Form No. 01b in the Appendix enclosed with Circular No. 43/2018 / TT-BCT;
b) Dossier as in the case of the application for the first time above.
4. In case of request for re-issuance because the establishment has changed the name of the establishment but does not change the owner of the establishment, the address, the location and the whole production process, business items
a) An application form according to Form No. 01b in the Appendix enclosed with Circular No. 43/2018 / TT-BCT;
b) A certificate of establishment meeting adequate conditions on food safety (a copy certified by the establishment).
5. In case of application for re-issue due to change of establishment owner but not change of establishment name, address, location and the whole production process, business goods
a) An application form according to Form No. 01b in the Appendix enclosed with Circular No. 43/2018 / TT-BCT;
b) A certificate of establishment meeting adequate conditions on food safety (a copy certified by the establishment);
c) A certificate of fitness for the owner of the facility, issued by a health facility of the district or higher level (a copy certified by the establishment);
d) Certificate of training in knowledge about food safety / Certificate of food safety knowledge of establishment owner (copy certified by the establishment).

Secondly, regarding the procedures and procedures for the grant of certificates of satisfaction of food hygiene and safety conditions:
Competent agencies are responsible for receiving and checking the validity of dossiers, conducting field verification and granting certificates to establishments meeting food safety conditions. Procedures and procedures for granting the Certificate are as follows:
1. For cases of first-time grant
a) Receive and check the validity of the application
Within 05 working days after receiving the dossier, the competent agency shall organize the examination of the validity of the dossier; In case of invalid dossier, the competent agency must send a written notice and request the establishment to supplement the dossier. Within 30 days from the date of notification of request for supplement of dossier, if the establishment does not respond, the dossier will be no longer valid.
b) Establishment of a field inspection team at the facility
Within 10 working days after receiving a complete and valid dossier inspection result, the competent agency shall organize a practical evaluation at the establishment. In case the superior competent authority authorizes on-site verification to the lower-level competent authority, a letter of authorization is required. After the appraisal, the competent agency at the lower level must send the evaluation report to the superior agency for use as a basis for granting the certificate.
The on-site appraisal team at the establishment is established by the certificate-granting authority or the agency authorized to conduct the appraisal. Appraisal team consists of 03 to 05 members, including at least 02 members working on food safety or food safety (with food or food safety qualifications) or management of food safety (field inspection team is invited to independent experts with appropriate expertise). The appraisal team leader is responsible for the actual evaluation results at the facility.
c) Contents of actual assessment at the facility
Check the legality of the application for the Certificate to the competent authority with the original filed at the facility; Evaluate food safety conditions at the facility as prescribed.
d) Results of physical verification at the facility
The appraisal results must clearly state “Pass” or “Fail” or “Wait for completion” in the minutes of evaluation of food safety conditions for food manufacturers according to Form No. 03a, Minutes of evaluation for food safety requirements for food business establishments, made according to Form No. 03b or a combination of Form No. 03a and Form No. 03b for establishments producing and trading food according to the Appendix enclosed herewith ;
For general food businesses, establishments are granted certificates when the business conditions of at least one product group are rated “Pass”. The product groups that meet the prescribed requirements will be written in the certificate of establishment meeting food safety conditions;
In case of “Failure” or “Waiting for completion”, the reasons therefor must be clearly stated in the evaluation record. In case of “Waiting for completion”, the maximum time limit for remedy is 60 days. After having corrected at the request of the appraisal team, the establishment must submit a report on the remedy result according to Form No. 04 in the Appendix to this Circular and pay the evaluation fee to the competent agency for the organization. re-evaluation according to the provisions of Point c of this Clause. The maximum time for reevaluation is 10 working days after the competent agency receives a corrective report. After 60 days the establishment fails to submit the corrective result report, the dossier of application for the establishment certificate of food safety eligibility and previous evaluation results with the conclusion that “waiting for completion” is no longer valid. ;
If the re-evaluation result is “Not passed” or the deadline for remedying but the establishment does not submit the remedial result report, the competent agency shall notify in writing to the local management agency for supervision and request. facility bridges are not allowed to operate until a certificate is issued;

d) Issue the certificate
Within 05 working days since the result of the actual assessment at the establishment is “Pass”, the competent authority shall issue a Certificate to the establishment according to Form No. 05a (for production facilities), Form No. 05b (for business establishments) and Form No. 05c (for both production and business establishments) in the Appendix issued together with this Circular.
2. In case of re-issue due to the loss or damage of the certificate
Within 03 working days from the date of receiving a valid application, based on the record, the competent authority has issued a review and reissue certificate. In case of refusal to re-issue, it must notify in writing and clearly state the reason.
3. In cases where establishments change production and / or business locations; change and supplement production processes, business items and when the certificate expires
Procedures for granting Certificates comply with Clause 1 of this Article.

4. Where an establishment changes its name but does not change its owner, address, location and the whole production process, business items
Within 03 working days from the date of receiving a valid application, based on the record, the competent authority that issued the review and reissue certificate, in case of refusal to re-issue, must notify. in writing and clearly stating the reason.

6. In case the chain of food business establishments increase or decrease to the business establishment, the adjustment of Certificate shall comply with the provisions of Clause 3 of this Article for such increase or reduction establishment.
7. In cases where establishments produce and trade in products specified in Clauses 8 and 10, Article 36 of the Government’s Decree No. 15/2018 / ND-CP of February 2, 2018, the appraisal of mechanical conditions Department of Industry and Trade shall comply with the provisions of the respective branches and domains.
